This Year, We’re Keeping Score for Paid Leave

The first scorecard from Paid Leave for All Action and the National Partnership for Women & Families Action Fund highlights where members of Congress stand on recent legislation critical to enacting a national paid family and medical leave program — the House-passed Build Back Better Act, the FAMILY Act (H.R. 804/S. 248), and the Job Protection Act (H.R. 6938/S. 3748).

The House-passed Build Back Better Act included what would have been the nation’s first-ever comprehensive, universal paid family and medical leave program. If enacted, it would have allowed nearly all working people to take up to four weeks of paid leave to welcome a new child, care for a family member, or care for their own health conditions. We commend all members of the House of Representatives who voted in favor of this landmark legislation.

The paid leave program in the Build Back Better Act was built off of the FAMILY Act, the only standalone bill before Congress that would create a universal paid family and medical leave program. It would provide up to twelve weeks of paid leave for the same purposes as the Build Back Better Act, plus to care for a servicemember or address needs related to a family member’s deployment. While the Build Back Better Act and the FAMILY Act provide wage replacement while someone is on leave, it relies on the Family and Medical Leave Act (FMLA) to protect that person’s job. However, the FMLA only protects 56 percent of workers, leaving the rest vulnerable to being fired while out on leave, or preventing them from taking leave at all for fear of being fired. The Job Protection Act is a key complement to the Build Back Better Act and the FAMILY Act by expanding eligibility for job protection under the FMLA, so that all workers have the guarantee of paid, job-protected leave. These evaluations come on the heels of moments where policymakers have come closer than ever to the passage of a federal paid leave policy. Recent polling from groups such as Navigator and Global Strategy Group have confirmed ahead of November’s midterms and the start of the next Congress that voters are overwhelmingly in favor of paid leave, and it remains one of the most widely supported policies in the country—and one that would benefit every working family and small business in the country.
